Article 1. Definitions

  1. Salon Nance@Home Hair&Nails is a sole proprietorship that aims to offer and carry out cosmetic treatments, including hair treatments and nail treatments. She also offers hair and nail products on the Website and in the salon.

Article 2. Applicability of the General Terms and Conditions

Article 3. The Agreement

  1. All offers on the Website are entirely without obligation, unless expressly stated otherwise.
  2. The Customer can contact Salon Nance@Home Hair&Nails via the Website, e-mail or telephone for any of the Services offered. Customer has the option to make an appointment via the Website, by telephone or in the store. The Agreement is only concluded through an order confirmation via the Website, e-mail or telephone.
  3. Customer can purchase various Products that Salon Nance@Home Hair&Nails offers. These Products are available in the store and also in the Webshop.
  4. Customer can place orders for Products in the Webshop of Salon Nance@Home Hair&Nails, which can be found on its Website. The Agreement is then concluded by placing an order on the Website.
  5. If Salon Nance@Home Hair&Nails sends a confirmation to the Customer, it is decisive for the content and interpretation of the Agreement, subject to obvious errors. Article 4. Execution of the Agreement

  1. Salon Nance@Home Hair&Nails will make every effort to provide the Services to the best of its knowledge and ability and in accordance with the requirements of good workmanship, including the professional execution of hair and nail treatments through the use of proper means and materials, as well as to carry out as much as possible in accordance with the written agreements.
  2. The Customer ensures that all information that Salon Nance@Home Hair&Nails indicates is necessary or of which the Customer should reasonably understand that it is necessary for the execution of the Agreement, will be provided to Salon Nance@Home Hair&Nails in a timely manner. If the information required for the execution of the Agreement has not been provided to Salon Nance@Home Hair&Nails in a timely manner, it reserves the right to suspend the execution of the Agreement and/or to pay the additional costs resulting from the delay in accordance with the then usual rates. to be charged to the Customer.
  3. The Customer ensures that Salon Nance@Home Hair&Nails can provide its Services in a timely and proper manner. Article 5. Changes to the Agreement

  1. If during the execution of the Agreement it appears that it is necessary to change or supplement it for its proper execution, Salon Nance@Home Hair&Nails and the Customer will adjust the Agreement by mutual agreement.
  2. If the Agreement is amended, including a supplement, this constitutes an additional assignment. A separate fee agreement will be made in advance for this additional assignment. Without an additional quotation, the original conditions apply, with the additional Services being paid at the usual rate.
  3. Failure to execute the amended Agreement or not immediately execute it does not constitute a breach of contract on the part of Salon Nance@Home Hair&Nails and is not a reason for the Customer to terminate or dissolve the Agreement .
  4. Changes to the originally concluded Agreement between Salon Nance@Home Hair&Nails and the Customer are only valid from the moment these changes have been accepted by both parties by means of an additional or amended Agreement . This change will be made in writing.

Article 6. Suspension, dissolution and interim termination of the Agreement

  1. Salon Nance@Home Hair&Nails is entitled to suspend the fulfillment of its obligations or to terminate the Agreement if the Customer does not fulfill the obligations under the Agreement, not fully or not on time. fulfills these obligations, or has good reason to fear that the Customer will fail to meet those obligations.

Article 7. Cancellation

  1.   2. If the cancellation takes place within 24 hours before the start of the agreed appointment, the Customer is obliged to pay 100% of the agreed fee.

Article 8. Costs, fees and payment

  1. All amounts stated in the quotation or on the website are in euros and include VAT, unless stated otherwise.

  3. Payment via the website is made in advance via iDeal. Payment in the store is made in cash or by bank transfer.
  4. Payment in installments is not possible.

Article 9. Shipping and Delivery

  1. If an order is lost or received damaged, a suitable solution will be sought in consultation.
  2. Salon Nance@Home Hair&Nails determines the method of transport and packaging itself. Salon Nance@Home Hair&Nails can choose to deliver the Products personally, but can also choose delivery via PostNL or another postal carrier.

Article 10. Returns

  1. Products can be returned within 14 days of receipt, without giving a reason. The entire amount paid by the Customer, including shipping costs, will be fully refunded within 14 days of receipt of the Product.
  2. Customer is obliged to handle the received product with care during these fourteen days. If the Customer decides to return the Products and it is not necessary to remove the packaging, Salon Nance@Home Hair&Nails asks that he refrain from doing so.
  3. Customer can return the Product via a postal company of his choice. The direct costs of returns will be borne by the Customer.
  4. If Customer wishes to return the order, Customer must download and complete the returns form from the Website. The Customer must include this form with the return shipment.

Article 11. Liability

  1. The Customer is responsible for providing correct and representative data and information necessary for the execution of the Agreement.   9. The liability of Salon Nance@Home Hair&Nails is limited to the amount covered and paid out by the insurer. If the insurer does not pay out, or if Salon Nance@Home Hair&Nails is not insured, liability is limited to the amount paid by the Customer.

Article 12. Force majeure

  1. Force majeure means all external causes, beyond the control or fault of Salon Nance@Home Hair&Nails, as a result of which timely, complete or correct fulfillment of the Agreement is no longer possible .
  2. Force majeure as referred to in the previous paragraph also includes, but is not limited to: non-compliance by a third party, illness of personnel of Salon Nance@Home Hair&Nails itself , abnormal weather conditions, disruptions in water and energy supplies, strikes, serious disruptions in the systems of Salon Nance@Home Hair&Nails, fire, floods, natural disasters, riots, war or other civil unrest.
  3. In the event of force majeure, performance of the Agreement will be suspended as long as the force majeure continues.
  4. If the force majeure lasts longer than one month, both parties are entitled to terminate the Agreement without judicial intervention. In such a case, Salon Nance@Home Hair&Nails will refund any amounts paid, minus all costs incurred by Salon Nance@Home Hair&Nails in relation to the Agreement.

Article 13. Warranty

  1. Salon Nance@Home Hair&Nails offers a legal guarantee for the Products it supplies against material and manufacturing defects. The warranty means that it will repair errors to the best of its ability and replace it if necessary. Defects must be reported in writing to Salon Nance@Home Hair&Nails.
  2. The warranty does not apply if the errors are wholly or partly the result of incorrect, incompetent, careless use, use for purposes other than normal or external causes, including but not limited to: not just fire or water damage.
  3. The warranty also does not apply if the Products have been modified or maintained by third parties.
  4. The warranty period is from the time of delivery, unless otherwise agreed.

  6. The provisions of the general terms and conditions regarding warranty do not affect the Customer's warranty claims under the law.

Article 14. Confidentiality of data

  1. Each party guarantees that all information received from the other party that it knows or should know is of a confidential nature will remain secret. The party that receives confidential information will only use it for the purpose for which it was provided. Data will in any case be considered confidential if it has been designated as such by one of the parties. Salon Nance@Home Hair&Nails cannot be held to this if the provision of data to a third party is necessary pursuant to a court decision, a legal regulation or for the correct execution of the agreement.
  2. Salon Nance@Home Hair&Nails ensures that all processing of Customer's personal data is in accordance with the General Data Protection Regulation. This means, among other things, that Salon Nance@Home Hair&Nails only collects personal data on the basis of one of the permitted legal grounds and that the Customer can at any time submit a request for the deletion of his personal data.

Article 15. Complaints procedure

  1. If the Customer has a complaint, the Customer must send this in writing to Salon Nance@Home Hair&Nails via info@nanceathome.nl or via the contact form on the Website.
